1.2 The Essex Card is a local discount and loyalty scheme that connects Shoppers with independent businesses across Essex. By holding an Essex Card, Shoppers gain access to exclusive discounts and offers at participating independent businesses. The scheme is available to businesses that are independently run; we do not accept supermarkets, franchises, chains, or corporations.
2. Definitions
In these Terms and Conditions, the following definitions apply:

"Essex Card" or "The Card" means the physical or digital card issued to a Shopper upon subscription, granting access to offers from Participating Businesses.

"Shopper" means any individual who has signed up to The Essex Card scheme as a cardholder.

"Participating Business" means any independently run business based in Essex that has registered with and been accepted onto The Essex Card scheme.

"Offer" means the discount, deal, or exclusive benefit made available by a Participating Business to Shopper cardholders.

"Scheme" means the overall Essex Card programme, including the website, card, directory, and all associated services.
3. Shopper Terms
3.1 Eligibility
To sign up as a Shopper, you must be at least 18 years of age and a resident of or regular visitor to Essex. By completing the sign-up process, you confirm that the information you have provided is accurate and complete.
3.2 Your Essex Card

Your Essex Card is personal to you and is non-transferable. It must not be lent to, shared with, or used by any other person.

Your card grants you access to the offers listed for Participating Businesses on our website and in any associated materials. Offers are provided at the sole discretion of each Participating Business and are subject to change without notice.

We reserve the right to cancel or suspend your card if we have reason to believe it is being misused, shared, or used fraudulently.
3.3 Subscription and Payment

Access to The Essex Card scheme requires payment of the applicable subscription fee as stated at the time of sign-up.

Subscription fees are non-refundable once your card has been issued, unless required by law or as otherwise stated at the point of purchase.

We reserve the right to change subscription pricing. Any changes will be communicated to existing Shoppers in advance.
3.4 Using Your Card

To redeem an offer, you must present your valid Essex Card (physical or digital) to the relevant Participating Business at the time of the transaction, before your purchase is processed.

Offers cannot be applied retrospectively after a transaction has been completed.

Each Participating Business sets its own offer terms. Always check the specific offer details before visiting, as availability, restrictions, and expiry dates may apply.

We cannot guarantee that any offer will be available at all times. Participating Businesses may withdraw, amend, or suspend offers without prior notice.

Offers cannot be combined with any other promotions, vouchers, or discount schemes unless expressly stated by the Participating Business.
3.5 Directory

Our online directory is updated regularly, but the number and availability of Participating Businesses may vary. Inclusion in the directory does not guarantee that a business is currently active or that their offer is available.

We do not accept liability for any journey, booking, or expense incurred on the basis of information in the directory that is found to be outdated or inaccurate.
4. Participating Business Terms
4.1 Eligibility to Join
To join The Essex Card as a Participating Business, you must:

Be an independently owned and operated business based in Essex.

Not be a supermarket, franchise, chain, or part of a national or international corporate group.

Provide accurate details about your business, including name, address, contact information, and the offer you wish to make available to Shoppers.
We reserve the right to decline any application or remove any Participating Business from the scheme at our discretion, including where a business no longer meets our eligibility criteria.
4.2 Your Offer

As a Participating Business, you are responsible for defining, communicating, and honouring your offer to all valid Essex Cardholders.

Your offer must be genuine and of reasonable value. We reserve the right to require you to amend or remove any offer that we consider misleading, inappropriate, or contrary to the spirit of the scheme.

You may update, amend, or withdraw your offer at any time. You must notify us promptly of any changes so that we can update the directory accordingly. Until the directory is updated, you remain responsible for communicating any changes to Shoppers presenting a valid card.

You must never refuse to honour a valid, current offer to a Shopper presenting a valid Essex Card, except where you have a legitimate legal or safety reason to do so.
4.3 Listing on The Essex Card Directory

By joining the scheme, you grant us a non-exclusive licence to display your business name, logo, description, images, address, and offer details on our website, social media channels, and any other marketing materials associated with The Essex Card.

You are responsible for ensuring that all information you provide to us for listing purposes is accurate, up-to-date, and not misleading.

We may edit listings for formatting, clarity, or presentation purposes, but we will not materially misrepresent your business without your consent.
4.4 Business Subscription and Fees

Participation in The Essex Card scheme may be subject to a fee as communicated at the time of sign-up. Full details of any applicable fees will be provided during the registration process.

Any fees paid are non-refundable except as required by law or as otherwise agreed in writing.

We reserve the right to amend our business subscription pricing with reasonable notice.
4.5 Conduct and Compliance

You must comply with all applicable laws, regulations, and licensing requirements in relation to the operation of your business and the fulfilment of any offer made to Shoppers.

You must treat all Essex Cardholders fairly, courteously, and without discrimination.

Any complaints received by us relating to your business or your offer will be investigated and may result in suspension or removal from the scheme.
4.6 Removal from the Scheme
We reserve the right to remove a Participating Business from the scheme at any time if:

The business no longer meets our eligibility criteria (e.g. it becomes a franchise or part of a chain).

The business fails to honour its published offer to valid Essex Cardholders.

The business provides false or misleading information.
-
We receive substantiated complaints from Shoppers.
-
The business acts in a manner that is detrimental to the reputation of The Essex Card.
5. Website Use
5.1 The content on our website (www.theessexcard.com) is provided for general information purposes. We aim to keep all information accurate and up to date, but we make no warranties or representations about the completeness, accuracy, or reliability of the content.
5.2 You may not use our website in any way that is unlawful, harmful, or in breach of these Terms and Conditions. This includes, but is not limited to:

Attempting to gain unauthorised access to our systems or data.

Reproducing, copying, or distributing content from our website without permission.

Using automated tools or bots to scrape or harvest data from our website.

7.1 The Essex Card acts as a platform connecting Shoppers with Participating Businesses. We are not a party to any transaction between a Shopper and a Participating Business and are not responsible for the quality, safety, legality, or suitability of any goods or services provided by Participating Businesses.
7.2 We do not guarantee the continued participation of any business in the scheme, nor the ongoing availability of any offer.
7.3 To the fullest extent permitted by law, we exclude all liability for any loss or damage arising from:

Your reliance on information contained in our directory.

A Participating Business withdrawing, amending, or failing to honour an offer.

Any dispute between a Shopper and a Participating Business.

Technical failures, interruptions, or inaccuracies on our website.
7.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded or limited.
8. Data Protection and Privacy
8.1 We take the privacy of our Shoppers and Participating Businesses seriously. We collect and process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
8.2 By signing up to The Essex Card scheme, you consent to us using your personal data for the purposes of administering your membership, managing the directory, communicating offers and updates, and improving our services.
8.3 We will not sell your personal data to third parties. We may share data with Participating Businesses to the extent necessary to administer the scheme.

9. Changes to the Scheme and These Terms
9.1 We reserve the right to amend, suspend, or terminate The Essex Card scheme, or any part of it, at any time. Where possible, we will give reasonable notice of any significant changes.
9.2 We may update these Terms and Conditions from time to time. The current version will always be available on our website. Continued use of The Essex Card or our website following any update constitutes acceptance of the revised terms.
10. Complaints and Disputes

10.2 If you experience a problem with a Participating Business, we will do our best to assist in resolving the matter, but we cannot be held responsible for the actions of individual businesses.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
